Terms of Service
These terms apply to forkcast.com.au and the website design services we provide. The site and services are operated by Mike Drops Pty Ltd (ABN 84 691 269 182), trading as Forkcast, Sydney, Australia ("we", "us", "our").
By using this site or engaging us, you agree to these terms. If you don't agree, please don't use the site or our services.
What we do
We design and build websites for hospitality venues and small businesses. The exact scope, deliverables, timeline and price for your project are agreed with you in writing (a quote, proposal or order) before work begins. Where those written details differ from this page, the written agreement for your project applies.
Quotes, fees and payment
- Prices shown on the site are a guide and may change. The price for your project is the one set out in your written quote or order.
- Payments are processed securely by Stripe. By paying, you authorise the charge for the agreed amount.
- Deposits, milestones or upfront payments may be required as set out in your quote or order. Work generally begins once any required payment is received.
Your Australian Consumer Law rights
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms removes or limits those rights. Where the law allows us to limit our liability, our liability is limited to re-supplying the services or paying the cost of having them re-supplied.
What we don't promise
We build high-quality websites and set them up with sound search-engine and trust fundamentals. However, we do not guarantee any specific outcome, such as a particular Google ranking, search position, amount of traffic, number of bookings, sales or revenue. These depend on many factors outside our control, including your market, content, pricing and how the site is used after handover.
Your responsibilities
- Give us accurate, complete information and any content (text, images, logos, menus) we need, on time.
- Make sure you own, or are licensed to use, any material you provide to us, and that it doesn't infringe anyone's rights or break the law.
- You are responsible for the lawful operation of your own website after handover, including its content, claims, and any required notices.
Intellectual property
Once your project is paid in full, you own or are granted a licence to use the final website delivered to you, as set out in your project agreement. We may retain ownership of our underlying templates, components, code and tools, and of any general know-how. Unless you ask us not to, we may show your finished website in our portfolio and marketing.
Third-party services
Your website and our service may rely on third-party tools (for example payments, scheduling, hosting, fonts and an AI assistant). Those services are provided by their own operators under their own terms, and we are not responsible for their availability or actions.
Availability
We aim to keep the site available but do not guarantee it will be uninterrupted or error-free, and we may change, suspend or withdraw parts of it.
Limitation of liability
To the extent permitted by law, and subject to your Australian Consumer Law rights above, we are not liable for indirect or consequential loss, or for loss arising from matters outside our reasonable control.
Privacy
How we handle personal information is set out in our Privacy Notice.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.
